This Privacy Policy (“Policy”) explains how MinkMap Inc. (“MinkMap,” “we,” “our,” or “us”) collects, uses, shares, and safeguards your personal data when you access or use our website, desktop application, mobile application, APIs, services, or developer tools (collectively, the “Service”).

By accessing or using the Service, you consent to the collection and processing of your data as described in this Policy. If you do not agree, do not use the Service.

1. WHO WE ARE

MinkMap Inc. is a Canadian technology company headquartered in Toronto, Ontario. We provide geolocation simulation software strictly for developer testing and research purposes.

We act as a Data Controller for the personal data we collect directly and as a Data Processor for any developer-provided test data.

2. WHAT DATA WE COLLECT

We collect the following types of data:

Email address
Account registration details
Support tickets or feedback messages
Developer test parameters

B. AUTOMATICALLY COLLECTED DATA

IP address and device ID
OS type and version
Browser type and version
Usage logs and diagnostic reports
Timestamps, interactions, and error data
Pseudonymized location simulation inputs (for debugging only)

C. PAYMENT INFORMATION

Processed via third-party services like Stripe
We do not store full payment card details
We retain billing metadata (e.g., invoice ID, subscription type)

3. LEGAL BASES FOR PROCESSING

Under GDPR, UK GDPR, and equivalent international laws, our lawful bases include:

Consent: Where required (e.g., optional surveys)
Contractual necessity: For account management, access, and delivery
Legal obligation: Where necessary to comply with law (e.g., tax regulations)
Legitimate interests: System maintenance, fraud detection, product improvements
Vital interests: Detecting or preventing harm or abuse

4. HOW WE USE YOUR DATA

We use your personal data to:

Create and maintain user accounts
Provide and improve the Service
Authenticate access and prevent fraud
Process payments and issue invoices
Respond to support inquiries
Monitor platform health and performance
Enforce legal agreements and protect against abuse

We do not use your data for unsolicited marketing, profiling, or behavioral tracking.

We do not sell your data. We may share limited personal data under strict contracts with:

Canadian adequacy status under EU law
Data Processing Agreements (DPAs) with vendors

7. DATA RETENTION

We retain data for only as long as necessary for legal, operational, or security purposes:

Account metadata: retained until deletion request
Billing records: retained 7 years (tax compliance)
Crash and usage logs: retained 12 months
Support emails: retained 12 months (unless requested for deletion)
Test simulation logs: retained up to 30 days

8. DATA SECURITY

We implement robust administrative, technical, and physical safeguards:

Encrypted data transmission (TLS 1.2 or higher)
Hashing and salting of credentials
Role-based internal access control
Security logging and anomaly detection

Despite best efforts, no system is 100% secure. You use MinkMap at your own risk.

9. YOUR RIGHTS (BY REGION)

A. EU/EEA & UK (GDPR)

You may:

Access or correct your data
Request deletion or restriction
Withdraw consent
Object to processing
Lodge a complaint with a supervisory authority

B. UNITED STATES (CCPA/CPRA)

California residents may:

Request access, correction, or deletion of personal data
Opt out of the “sale” of personal information (we do not sell data)
Exercise data rights without discrimination

We honor data rights globally as required by:

10. CHILDREN’S PRIVACY

MinkMap is not directed to children under 18 and we do not knowingly collect their data.
If we learn that we have collected personal data from a minor, we will delete it immediately.

11. COOPERATION WITH LAW ENFORCEMENT

We may preserve, disclose, or report data when:

Required by valid legal process;
Necessary to investigate fraud or abuse;
Needed to comply with Canadian or international legal obligations.

We are not responsible for user actions and reserve all legal rights to respond to subpoenas, warrants, or court orders.

12. LIMITATION OF LIABILITY

MinkMap shall not be held liable for:

User misuse or unauthorized access to accounts;
Data loss caused by platform bans, app blocks, or network issues;
Consequences from spoofing behavior, platform restrictions, or user negligence.

Your use of the Service constitutes your agreement to hold us harmless.

13. CHANGES TO THIS POLICY

We may revise this Policy periodically. We will provide at least 15 days’ notice for material changes via email or in-app alert.
